# Privacy policy

This privacy policy explains how Zenith Clubhouse handles information shared through its website, invitation applications, newsletter subscriptions and related inquiries. It describes what is collected, why it is used, when providers may receive it, and how you can ask about your information or exercise rights available under applicable law.

Draft updated: October 9, 2026

Draft — pending legal review. Not a final policy or program agreement.

## 1. Who is responsible for your information?

This policy describes how Zenith Clubhouse handles personal information collected through www.zenithclubhouse.com, application and newsletter forms, inquiries and related services. The operating entity is Zenith Clubhouse, a New York-based, invitation-only performance club led by Boaz Gilad. Contact legal@zenithclubhouse.com with privacy questions or requests.

## 2. What information do you provide?

Invitation applications collect your full name, email address and your answer about why you are applying. Newsletter forms collect your first name and email address. We also store the page from which a form was submitted and a submission timestamp. Information you voluntarily include in application answers or correspondence may describe your role, company, ambitions or circumstances.

If you contact Zenith, we may retain your inquiry and related correspondence to respond and manage the relationship. Please do not submit passwords, payment-card details, government identification numbers, medical records or confidential information belonging to another person through these forms.

The First Move is currently a preview: its form does not save registrations. When live registration is enabled, it is designed to collect first name, email, an optional focus area, consent and consent wording, referral and campaign information, and internal delivery status. This policy should be reviewed before that launch.

## 3. What information comes from visiting the website?

Hosting and security services may process technical information such as IP address, browser and device information, request times, requested pages and error logs to deliver and protect the website. This is separate from the answers you provide in a form.

The website stores your light or dark theme preference in your browser’s local storage. It uses session storage to preserve your page position when you open and close the invitation form. These settings support the website experience; they are not newsletter consent.

## 4. How is your information used?

Information is used to review invitation requests personally, respond to inquiries, discuss relevant programs, maintain application records, manage requested newsletter subscriptions and protect forms against spam or misuse. Where you become a client, information needed for the engagement may also be used to administer the agreed services.

The website captures newsletter subscriptions; Smartlead handles email delivery when configured. The application does not itself send marketing emails. Requesting an invitation is not, by itself, a request to join the newsletter. No automated email delivery to The First Move registrants is provided by the app.

Where a law requires a legal basis for processing, the appropriate basis may be steps you request before an engagement, performance of an agreement, legitimate interests in responding to inquiries and securing the site, legal obligations, or consent where required. Any reliance on legitimate interests remains subject to your rights under applicable law.

## 5. Who may receive your information?

Personal information may be processed by providers supporting website hosting, data storage, security, communications and service administration, only as needed for those purposes. Newsletter delivery is handled through Smartlead. Resend is planned for a later configuration; it is not currently enabled for delivery through this site.

Information may also be disclosed when reasonably necessary to comply with law or valid legal process, protect people or legal rights, investigate misuse, or support a business transfer subject to appropriate protections. We do not sell personal information. We do not publish application answers or use them as testimonials without permission.

## 6. How are coaching and group discussions treated?

This website policy does not replace a program’s confidentiality agreement. The Game, Workshops & Forum, Private Advisory and Teams & Sales may involve sensitive personal or business discussions. The scope of confidentiality, any agreed sponsor reporting and any recording arrangements should be set out in the applicable engagement agreement before participation.

Other participants are not website service providers. Do not assume that information shared in a group is subject to legal privilege or that confidentiality can be guaranteed by a website policy. Share only information you are entitled to disclose, and follow the program’s confidentiality commitments.

## 7. What happens when you use external content?

Links to Substack, podcast platforms, booksellers and social profiles take you to independent services governed by their own policies. This website loads fonts from Google’s font services, which may receive technical request information such as your IP address when a font is requested.

The podcast page loads a YouTube privacy-enhanced player only after you choose to load the playlist. Loading or interacting with that player can transmit information to YouTube or Google and may involve their storage or cookies. Privacy-enhanced mode does not mean no data is processed. Review those providers’ policies before interacting.

## 8. How long is information kept?

Retention should be limited to the period reasonably needed to evaluate applications, manage relationships and subscriptions, provide agreed services, address disputes and comply with legal obligations. Unsubscribing does not necessarily remove every record: a minimal suppression record may be needed to respect your choice. Copies in backups may remain until the relevant backup cycle expires.

## 9. How can you manage emails and browser storage?

You may unsubscribe from marketing messages using the unsubscribe option in the message, or ask for removal by emailing legal@zenithclubhouse.com. Essential correspondence about an inquiry or active engagement is separate from marketing. Newsletter registration does not mean an email has already been sent.

You can clear or restrict cookies and local storage through your browser settings. This may reset your theme preference, page position or sign-in session. A browser’s Do Not Track setting is not a substitute for an unsubscribe request. Any legally required handling of recognized privacy signals must be confirmed against the tools actually deployed.

## 10. What privacy rights may you have?

Depending on where you live and which laws apply, you may have rights to access or obtain a copy of your information, correct it, request deletion, restrict or object to processing, withdraw consent, or opt out of certain uses. Some jurisdictions provide portability, appeal or authorized-agent rights. These rights are subject to applicable conditions and exceptions; this policy does not promise rights that the law does not provide.

Send a request to legal@zenithclubhouse.com with enough information to identify the relevant interaction. We may need to verify your identity or an agent’s authority, without asking for unnecessary sensitive information. Requests will be handled within applicable legal time limits. Where available, you may also complain to your local data protection authority. Exercising an applicable privacy right will not result in unlawful discrimination.

## 11. How is information protected and transferred?

Application and subscriber records are stored with restricted access. Reasonable administrative and technical safeguards are used to reduce unauthorized access, loss and misuse. No website, storage system or email transmission can be guaranteed completely secure; avoid sending sensitive information by ordinary email.

Zenith is based in the United States. Providers may process information in the United States or other locations with different privacy laws. Where international transfer safeguards are legally required, they must be established for the relevant provider and transfer before that processing occurs.

## 12. Is the website intended for children?

Zenith’s website and programs are directed to founders, executives, athletes and other high achievers, not to children under 13. We do not knowingly seek personal information from children under 13. If you believe a child has submitted information, contact legal@zenithclubhouse.com so the matter can be reviewed and the information removed where required. Eligibility for any participant who is a minor must be addressed separately before an engagement.

## 13. How will this policy change?

Changes to website tools, programs or legal requirements may require updates. The revision date identifies the latest draft. Material changes should be communicated as required by applicable law, and additional consent obtained where necessary. This draft remains subject to legal review before adoption.
