Terms of use
These terms explain the rules for using the Zenith Clubhouse website, submitting an invitation request and accessing its content. They also distinguish website use from participation in a paid program. Coaching, cohorts, workshops and advisory engagements require their own written agreements, including the scope of services and commercial terms.
Draft updated: October 9, 2026
Draft — pending legal review. Not a final policy or program agreement.
1. What do these terms cover?
These terms govern use of www.zenithclubhouse.com and its information, forms and content. Zenith Clubhouse is a New York-based, invitation-only performance club led by Boaz Gilad. The website is operated by Zenith Clubhouse, which can be reached at legal@zenithclubhouse.com. By using the website, you agree to these terms to the extent permitted by applicable law. If you do not agree, do not use the website.
A separate written agreement governs paid coaching, cohorts, workshops, advisory services or speaking engagements. If these website terms conflict with that agreement about the engagement, the signed engagement agreement controls. These terms do not create a coaching relationship merely because you visit the website or submit a form.
2. What services does Zenith offer?
The Game is a small, vetted cohort using structured work and peer accountability. Workshops & Forum provides focused intensives and forum evenings. Private Advisory offers one-on-one work with Boaz. Teams & Sales provides keynotes, workshops and multi-session programs for leadership and sales teams. Format, scope, location and availability are confirmed for each engagement.
Website descriptions explain the services; they are not a binding promise of admission, availability, a specific timetable or a result. Books, articles, podcast episodes and newsletter material provide general information. A forthcoming book marked ‘Coming soon’ has no confirmed publication date unless one is expressly announced.
3. What happens when you apply?
Zenith is application-only. Every application is read personally. An application is a request for consideration, not a purchase, reservation or guarantee of admission. Zenith may accept or decline an application based on fit and program availability, subject to applicable law. No response time or place in a cohort is guaranteed by submitting the website form.
Provide accurate information that you are entitled to share. Do not impersonate another person or submit their details without authority. If you apply on behalf of a company, you must be authorized to do so. Eligibility, including any age or guardian requirements, is confirmed before an engagement.
4. How are fees, cancellations and changes agreed?
Fees, taxes, deposits, installment dates, scheduling, rescheduling, cancellation, refunds and any recurring commitment must be stated in the applicable written proposal or engagement agreement before acceptance. The website application form does not collect payment. No price, refund policy or cancellation deadline should be inferred from these website terms.
Material changes to an agreed engagement should be handled under that agreement and applicable law. Mandatory consumer rights remain unaffected. Purchases made through independent booksellers or other third parties are subject to their own checkout and refund terms.
5. What standards apply in the room?
Participants are expected to engage respectfully, honor agreed commitments, and avoid harassment, discrimination, threats, disruptive conduct or misuse of another participant’s information. A cohort or workshop is not permission to solicit other participants or use their contact details commercially without consent.
Zenith may restrict website access for misuse. Participant removal, suspension, resulting fees or refunds, and other program consequences must be addressed in the engagement agreement and applied consistently with applicable law. Website terms alone do not establish a forfeiture of paid fees.
6. How does confidentiality work?
Respect personal and business information shared by other participants. Do not record sessions, take screenshots of private discussions, distribute program discussions or publish another participant’s identity or comments without the required permissions. Only share confidential information that you are authorized to disclose.
The applicable program agreement should define confidentiality obligations, permitted disclosures, any sponsor reporting and recording permissions. Exceptions may be needed for legal obligations or safety. Coaching and peer discussions do not create attorney-client privilege. Zenith cannot guarantee that every participant will comply, and this website policy is not a substitute for a signed confidentiality agreement.
7. Is coaching professional advice or a guarantee?
Zenith provides performance coaching and educational services. It does not provide therapy, medical diagnosis or treatment, or licensed legal, tax, investment or financial advice. Content about business, real estate, health or relationships does not replace advice from an appropriately qualified professional who knows your circumstances.
You remain responsible for your decisions and actions. Participation does not guarantee revenue, profit, athletic performance, career advancement or a particular personal outcome. Any individual experience described with permission is not a promise that others will achieve the same result. Consult the relevant professional before making decisions requiring licensed advice.
8. Who owns the content and materials?
Website text, branding, books, frameworks, exercises, photographs and program materials are owned by Zenith Clubhouse, Boaz Gilad or their respective licensors, except where otherwise stated. You may view public content and use it for lawful personal, noncommercial reference. All other rights are reserved.
Without the rights holder’s written permission, you may not reproduce, sell, republish or distribute protected content, remove ownership notices, or use program materials to deliver a competing service. Access to a program does not transfer ownership of its materials. Any broader use must be expressly licensed. Rights and exceptions provided by applicable law are not excluded.
9. What website use is prohibited?
Do not use the website for unlawful activity; submit spam, malicious code or fraudulent information; attempt unauthorized access to private records or accounts; interfere with security or availability; harvest applicants’ or participants’ personal information; or bypass access controls. Any team account credentials must be kept private and used only by an authorized user.
Report suspected security issues or unauthorized access to legal@zenithclubhouse.com. Do not access information beyond what is necessary to identify the issue, copy private data, or publish personal information.
10. How do forms, subscriptions and external links work?
Form submissions are handled as described in the Privacy Policy. Requesting an invitation does not automatically subscribe you to the newsletter. A newsletter confirmation means your subscription was captured, not that an email has already been sent. Marketing emails, when sent, offer an unsubscribe option.
The First Move currently operates as a preview and does not save live registrations. A preview confirmation is not a promise of delivery. Any future delivery arrangement will be explained when live registration is enabled; the app does not automatically email the requested material to registrants.
External links and embedded media may lead to independent booksellers, Substack, social networks and podcast platforms. Their services, availability, content and policies are their own. Linking does not create a warranty or endorsement of all their content. Review their terms before purchasing or sharing information.
11. What limits apply to website availability and liability?
Reasonable efforts are made to keep information accurate and the website available, but errors, interruptions and outdated information may occur. To the extent permitted by law, public website content is provided ‘as is’ and ‘as available,’ without a warranty of uninterrupted operation or fitness for a particular purpose. Confirm important program details directly before relying on them.
To the extent permitted by applicable law, Zenith is not liable for indirect or consequential losses resulting from use of the public website. Nothing in these terms excludes liability or remedies that cannot lawfully be excluded, including applicable consumer protections. Liability connected with paid services should be addressed separately in the signed engagement agreement. These website terms do not impose an invented monetary cap or automatic indemnity obligation.
12. Which law applies and how can concerns be raised?
These website terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where mandatory laws applicable to you require otherwise. Rights or remedies that cannot lawfully be waived remain in effect.
If you have a concern, contact legal@zenithclubhouse.com with the relevant details so Zenith can seek to resolve it. These website terms do not require binding arbitration or waive class-action rights. Any specific dispute process or court venue for a paid engagement must be reviewed and agreed separately, subject to applicable law.
13. How are changes to these terms handled?
The revision date identifies the latest draft. Updated website terms may be posted as services or legal requirements change, with additional notice where required. Changes should not retroactively alter a signed engagement without the agreement and consent required by law. This draft remains subject to confirmation of commercial details and legal review before adoption.
